FUNd SENd Guided Customer Terms

These terms apply when an organisation purchases and uses FUNd SENd Guided.
1. ABOUT US
FUNd SENd Guided is provided by KOI Sports CIC, a Community Interest Company registered in England and Wales.

2. FUNd SENd GUIDED
FUNd SENd Guided is a structured, automated funding-application guidance service for eligible organisations developing SEND projects.
The current Guided service supports applications being developed for:
• Sport England Movement Fund; and
• National Lottery Awards for All England.
The funding programmes and their requirements may change from time to time.
3. PRICE
FUNd SENd Guided costs £29.99 as a one-off payment.
It is not a subscription.
Any applicable total charge will be displayed before the customer places the order.
4. ELIGIBILITY
Customers complete an initial eligibility process before the FUNd SENd Guided payment stage becomes available.
Passing this initial check means that the organisation has met the initial criteria used by FUNd SENd to access Guided.
It does not guarantee that the organisation or project will ultimately satisfy every requirement imposed by a funding organisation.
It also does not guarantee that an application will be accepted or funded.
5. WHAT GUIDED PROVIDES
Depending on the information relevant to the project, the Guided journey may include:
• Readiness Check;
• Project Builder;
• automated guidance;
• Budget Builder;
• evidence and quality checks;
• application-support material;
• Application Pack; and
• Submission Companion.
Guided is designed to help the applicant develop, organise and prepare information for its application.
6. WHAT GUIDED DOES NOT PROVIDE
FUNd SENd Guided does not include:
• a guarantee of funding;
• a guarantee of funder eligibility;
• a human bid writer;
• human bid review as part of the £29.99 product;
• financial, legal or professional advice;
• submission of the funding application by KOI Sports CIC;
• authority to make representations to a funder on the applicant's behalf.
7. APPLICANT RESPONSIBILITY
The applicant organisation remains responsible for the information it provides.
Applicants must check that information is accurate, current and complete before relying on it in an application.
The applicant organisation remains responsible for reviewing its final application and submitting it to the appropriate funding organisation.
The relevant funding organisation remains solely responsible for its eligibility assessment, application assessment and funding decision.
8. FUNDER REQUIREMENTS
FUNd SENd is designed around information available about the funding programmes it supports.
Funding organisations may change their eligibility rules, guidance, application questions, deadlines or assessment processes.
Where we become aware of material changes, we may update FUNd SENd accordingly.
Applicants should check the relevant funder's current requirements before final submission.
9. YOUR RESPONSIBILITIES
You agree to:
• provide information honestly and accurately;
• have appropriate authority to act for the applicant organisation;
• check information generated or structured through Guided;
• avoid supplying unnecessary identifiable personal or medical information about SEND participants;
• use the service lawfully;
• protect any account or access credentials provided to you;
• make the final decision about what information is submitted to a funder.
10. STARTING THE SERVICE
FUNd SENd Guided is intended to become available following confirmation of payment and activation of access.
Where applicable consumer cancellation rights apply, we will obtain any legally required request, consent or acknowledgement before beginning supply during a statutory cancellation period.
11. CANCELLATION AND REFUNDS
Cancellation and refund rights are explained in the FUNd SENd Guided Cancellation and Refund Policy.
Nothing in these terms removes or restricts any statutory rights that cannot lawfully be excluded.
12. SERVICE AVAILABILITY
We will take reasonable steps to keep FUNd SENd available and functioning properly.
Temporary interruptions may occasionally occur because of maintenance, technical problems, security requirements or services operated by third-party technology providers.
If a problem materially prevents delivery of the purchased service, contact us so that we can investigate and provide an appropriate remedy.
13. QUALITY OF THE SERVICE
KOI Sports CIC will provide the service with the standard required by applicable law.
Nothing in these terms excludes rights or remedies that cannot lawfully be excluded or restricted.
14. INTELLECTUAL PROPERTY AND PERMITTED USE
FUNd SENd, its structure, guidance, templates, systems and underlying materials remain the intellectual property of KOI Sports CIC or its licensors where applicable.
The purchasing organisation may use material generated for its own project and funding application.
Customers must not reproduce, resell, license, distribute or commercially exploit the FUNd SENd system, templates or underlying materials as a competing service.
15. LIABILITY
Nothing in these terms excludes or limits liability where doing so would be unlawful.
FUNd SENd supports preparation of an application but does not control decisions made by funding organisations. KOI Sports CIC is therefore not responsible merely because a funder rejects an application, requests additional information, changes its programme or decides not to award funding.
This does not affect any rights arising where FUNd SENd itself has not been supplied in accordance with applicable law or these terms.
16. COMPLAINTS AND SUPPORT
If you experience a problem with FUNd SENd Guided or believe the service has not been supplied as described, contact KOI Sports CIC using the contact details published on the website.

We will review the issue and respond as soon as reasonably practicable.
17. CHANGES
We may update these terms to reflect changes to FUNd SENd, supported funding programmes, technology or legal requirements.
The terms applying to a purchase will be those presented to the customer when the relevant contract is made, except where a change is required by law or subsequently agreed.
18. GOVERNING LAW
These terms are governed by the applicable laws of England and Wales.
Nothing in this section removes any mandatory legal rights a customer may have to bring proceedings in another part of the United Kingdom where applicable.
